Terms and Conditions of Sale
These general terms and conditions of sale (GTCS) govern sales concluded on the Patoune website, published by Adam Zemmouri, sole proprietor (SIRET 10482091500015).
Article 1 – Purpose
The GTCS define the rights and obligations of the parties in connection with the online sale of pet shop products offered on the website.
Article 2 – Prices
Prices are indicated in euros, all taxes included (VAT not applicable, art. 293 B of the CGI). Delivery costs are indicated before order validation. The seller reserves the right to modify its prices at any time, products being invoiced on the basis of the rates in force at the time of the order.
Article 3 – Order
The customer validates their order after checking the contents of their cart. The sale is concluded upon order confirmation. A confirmation email is sent to the customer.
Article 4 – Payment
Payment is made online by credit card, PayPal, Apple Pay, or Shop Pay, via a secure solution. The order is processed after receipt of payment.
Article 5 – Delivery
Products are shipped to the address indicated by the customer. Average delivery times: 5 to 8 working days in France; allow a little longer for the European Union and internationally. Delivery costs depend on the destination (France, European Union, International) and are displayed before payment. The seller cannot be held responsible for delays attributable to the carrier or to a case of force majeure.
Article 5 bis – Order Tracking
Upon shipment, an email containing a tracking number is sent to the customer. The customer can track the delivery of their package at any time from the Order Tracking page, or from their customer account. The tracking number is provided for informational purposes: its update depends on the carrier.
Article 5 ter – International Orders (outside the European Union)
We also ship outside the European Union, notably to the United States. For these orders: (i) no French VAT is applied (export outside the EU); (ii) the prices displayed do not include customs duties, import taxes, or any customs clearance fees of the destination country, which remain the responsibility of the customer and may be claimed by the carrier upon delivery; (iii) delivery times may be longer and depend on customs formalities. It is the customer's responsibility to ensure that the ordered products can be legally imported into their country.
Article 6 – Right of Withdrawal
In accordance with articles L.221-18 et seq. of the Consumer Code (and European directive 2011/83/EU), the customer has a period of 14 days from receipt to exercise their right of withdrawal, without having to provide a reason. The product must be returned new, unused, and in its original packaging. Return costs are the responsibility of the customer, except for defective products.
Article 7 – Refund
In the event of withdrawal, the refund will be made within a maximum of 14 days after receipt of the returned product, by the same payment method.
Article 8 – Legal Guarantees
All products benefit from the legal guarantee of conformity (articles L.217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
Article 9 – Liability
The products comply with current legislation. The seller cannot be held responsible in case of improper use of the product by the customer.
Article 10 – Personal Data
Collected data is processed in accordance with our Privacy Policy.
Article 11 – Disputes and Applicable Law
These GTCS are subject to French law. An amicable solution will be sought first. For customers residing in the European Union, the European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr. In the absence of an agreement, the competent courts will be seized.
